Privacy Policy
This policy explains what personal information we collect when you visit or buy from our stores for the United States, the United Kingdom, Canada, Australia and New Zealand, why we collect it, who we share it with and what rights you have.

2. What we collect
- Contact and delivery details – name, email address, delivery and billing address, and phone number if you give one.
- Order information – what you bought, order value, returns and exchanges, and your messages to us.
- Payment information – handled by our payment providers. We receive confirmation that a payment succeeded and limited details such as the card type and last digits. We never see or store your full card number.
- Account information – if you create an account.
- Technical information – IP address, device and browser type, pages viewed and how you move through the store, collected through cookies and similar technologies.
3. Why we use it
- To take, process and deliver your order, and to handle returns and support requests – this is necessary to perform our contract with you.
- To keep the store secure and to detect and prevent fraud – our legitimate interest.
- To understand how the store is used and improve it – our legitimate interest or, where the law requires it, your consent.
- To send you marketing emails if you have signed up – your consent. You can unsubscribe at any time using the link in every email.
- To meet legal obligations such as tax and accounting record-keeping.
4. Who we share it with
- Shopify, which hosts this store, its checkout and our marketing emails. Our contracting party is Shopify International Limited, 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4, Ireland; Shopify uses affiliates and service providers, including Shopify Inc. in Canada and data centres in the United States.
- Payment providers such as PayPal, Apple, Google and card processors, which are independently responsible for their own processing.
- Carriers and customs authorities, to deliver your parcel and clear it through customs.
- Professional advisers and authorities, such as accountants and tax authorities, where the law requires it.
We do not sell your personal information for money. We currently do not use advertising or analytics services from third parties such as Meta, Google or TikTok. If that changes, we will update this policy first.
5. Cookies
The store uses cookies that are necessary for the cart, country and language settings, and checkout to work. Cookies used for statistics are only set where you allow them, if the law where you live requires consent. You can change your choice through the cookie banner and delete cookies in your browser at any time.
6. International transfers
We are based in Hong Kong and our service providers operate in several countries, including Ireland, Canada and the United States. Your information may therefore be stored and processed outside the country where you live. Where the law requires it, we and our providers rely on recognised safeguards such as standard contractual clauses or the UK Extension to the EU-US Data Privacy Framework.
7. How long we keep it
We keep order records for as long as tax and accounting law requires. Marketing data is kept until you unsubscribe, after which we keep only what is needed to make sure you receive no further emails. Support messages are kept while they may still be relevant to your order.
8. Security
The store and checkout run on encrypted connections, and access to personal information is limited to people who need it. No method of transmission or storage is completely secure, but we take reasonable steps to protect your information.
9. Your rights
Depending on where you live, you can ask us to tell you what information we hold about you and give you a copy, correct it, delete it, restrict or object to how we use it, or send it to another provider. Where we rely on your consent, you can withdraw it at any time. To make a request, email support@bergheat.de. We may need to verify your identity first, and we will not treat you differently for making a request.
10. Country-specific information
United Kingdom. The UK GDPR and the Data Protection Act 2018 apply. Our legal bases are set out in section 3. You also have the right to data portability. You can complain to the Information Commissioner's Office at ico.org.uk.
United States. If you live in California or another state with a comprehensive privacy law, you can ask to know, access, correct and delete your personal information, and to opt out of the sale or sharing of personal information for targeted advertising. Some Shopify features may count as sharing under these laws; you can opt out on our Your privacy choices page, and we honour Global Privacy Control signals sent by your browser. If we decline your request, you can appeal by replying to our decision; if your state provides for it, you may then contact your state attorney general.
Canada. The Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws apply. You can access or correct your information and withdraw consent by writing to us. You can complain to the Office of the Privacy Commissioner of Canada; if you live in Quebec, also to the Commission d'accès à l'information du Québec.
Australia. We handle your information in line with the Australian Privacy Principles. Your information may be disclosed to recipients in Hong Kong, Ireland, Canada and the United States as described above. You can access or correct your information by writing to us, and complain to the Office of the Australian Information Commissioner (oaic.gov.au) if we cannot resolve your concern.
New Zealand. The Privacy Act 2020 applies. Your information may be disclosed overseas as described above. You can access or correct your information by writing to us, and complain to the Office of the Privacy Commissioner (privacy.org.nz) if we cannot resolve your concern.
11. Children
This store is not intended for children, and we do not knowingly collect personal information from them. If you believe a child has given us their information, contact us and we will delete it.
12. Changes
We update this policy when our data practices change or the law requires it. The current version is always the one published on this page.
